Court Schedules Snowbowl Rehearing
The Ninth Circuit Court of Appeals has granted a full En Banc court rehearing for Arizona Snowbowl's snowmaking case struck down last spring by a three-judge panel. The Snowbowl case, the Navajo Nation v. United States Forest Service, has been calendared for Dec. 11 at 3 p.m. in Pasadena, Calif.
Indian tribes and environmental groups under the Religious Freedom Restoration Act, the National Environmental Protection Act, and the National Historic Preservation Act challenged the Forest Service's approval of snowmaking on Humphrey's Peak. Save the Peaks Coalition, which opposes snowmaking, plans to caravan from Northern Arizona to Pasadena for the hearing.
