An Appeal Court ruling has turned a $300,000 ruling into $75,000 for Peter Kralik, who was injured on Mount Seymour’s Mystery Chair in 2003.
The court said the trial judge was in error when he failed to place any blame for the accident on Kralik, ruling the $300,000 award excessive.
Kralik, who has a Ph.D. in mathematics, fractured his humerus in the incident and argued his injury prevented him from doing jobs requiring lifting or reaching with his right arm.
